NO. 1 – PHILOSOPHY OF ISLAND LIVING

Terms of Use

Publisher: Island Review
Contact: legal@islandreview.com

Welcome to Island Review. We publish reported travel writing, guides, criticism, essays, recommendation lists, photographs, maps, and other material about islands and the occasionally complicated business of getting to them.

These Terms of Use govern your access to and use of the Island Review website, newsletters, and related digital services (together, the “Site”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Nothing in these Terms limits rights that cannot lawfully be limited under the laws applicable to you.

1. The Site and its purpose

Island Review provides editorial and informational content for readers interested in islands, travel, culture, nature, design, history, and related subjects.

Our articles are intended to inform, entertain, and occasionally persuade. They are not professional travel, medical, legal, financial, immigration, safety, insurance, or emergency advice. Travel conditions can change rather more quickly than prose: routes, weather, borders, public-health requirements, operating hours, prices, local rules, accessibility, safety conditions, and the existence of a promising-looking beach bar may all change without notice.

You are responsible for making your own travel and purchasing decisions, verifying current information directly with relevant providers and authorities, and obtaining appropriate insurance, documents, permits, and professional advice where needed.

2. Eligibility and acceptable use

You may use the Site only in compliance with these Terms and all applicable laws.

You agree not to:

  • Use the Site for unlawful, fraudulent, harmful, or abusive purposes.
  • Interfere with the security, availability, or ordinary operation of the Site.
  • Attempt to gain unauthorized access to accounts, systems, data, or networks connected with the Site.
  • Scrape, crawl, harvest, reproduce, or systematically download Site content except as permitted by applicable law or with our prior written permission.
  • Use automated tools, bots, or software to access the Site in a manner that imposes an unreasonable burden on it or bypasses access controls.
  • Remove copyright, trademark, author, photographer, or other proprietary notices.
  • Use the Site or its content to train, develop, or improve artificial-intelligence systems without our prior written permission, except to the extent such restriction is prohibited by applicable law.
  • Post or transmit material that is unlawful, defamatory, infringing, invasive of privacy, discriminatory, threatening, obscene, or otherwise objectionable.

We may suspend or restrict access where we reasonably believe these Terms have been breached, where necessary to protect the Site or other users, or where required by law.

3. Editorial content and changes

We strive for accuracy, independence, and good judgment. We do not promise that all Site content is complete, current, error-free, suitable for every reader, or available everywhere.

Island Review may revise, update, correct, remove, or discontinue content or features at any time. A restaurant may close, a ferry may be cancelled, and an opinion may improve with age; we cannot guarantee that every published detail will keep pace.

Unless expressly stated otherwise, an author’s views are their own and do not necessarily represent the views of Island Review, its publisher, editors, contributors, partners, advertisers, or affiliates.

4. Travel, safety, and third-party services

The Site may mention, review, recommend, or link to hotels, airlines, ferries, tour operators, restaurants, retailers, insurers, booking platforms, public authorities, and other third parties.

These references do not constitute a guarantee, endorsement, warranty, or representation that a third party, product, service, destination, or activity is safe, lawful, available, suitable, accessible, or of a particular quality. You should independently assess travel warnings, local laws, health and safety conditions, weather, accessibility, cancellation terms, and provider credentials before booking or participating in any activity.

Island Review is not a travel agent, tour operator, carrier, insurer, accommodation provider, or booking platform unless we expressly say otherwise in writing. Any booking, purchase, reservation, or contract you enter into with a third party is solely between you and that third party and subject to its terms, policies, and applicable law.

Where the Site provides links to third-party websites or services, those links are provided for convenience. We do not control their content, availability, privacy practices, security, prices, or terms.

5. Intellectual property

The Site and its contents—including text, reporting, photographs, illustrations, maps, graphics, logos, design, software, video, audio, newsletters, and compilations—are owned by Island Review, its contributors, licensors, or other rights holders and are protected by copyright, trademark, and other applicable laws.

Subject to these Terms, Island Review grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Site for your personal, non-commercial use.

You may share links to our work and make limited quotations with clear attribution and a link to the original page, where lawful. You may not reproduce, republish, sell, license, distribute, display, modify, create derivative works from, or commercially exploit Site content without prior written permission from the relevant rights holder, except as permitted by applicable law.

“Island Review” and associated logos, taglines, and marks are trademarks or trade names of its publisher or its licensors. No permission to use them is granted by these Terms.

For licensing, permissions, syndication, or reprint enquiries, contact: rights@islandreview.com.

6. User accounts, newsletters, and communications

If the Site permits accounts, subscriptions, comments, newsletter registration, or other interactive features, you agree to provide accurate information and to keep login credentials confidential. You are responsible for activity undertaken through your account, unless caused by our failure to protect it.

Marketing emails will be sent only in accordance with applicable law and our Privacy Notice. You may unsubscribe from marketing emails at any time using the link in the message or by contacting us. We may still send necessary service, security, transaction, or legal notices where permitted by law.

7. User contributions and submissions

If you submit comments, photographs, pitches, letters, story ideas, reviews, or other material to Island Review (“Submissions”), you represent that you have the necessary rights to submit that material and that its use will not violate another person’s rights or applicable law.

Unless we agree otherwise in a signed writing:

  • Unsolicited ideas and pitches are submitted at your own risk and may not be treated as confidential.
  • You retain ownership of your original Submission.
  • You grant Island Review a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, reproduce, adapt as necessary for format and accessibility, publish, display, distribute, and promote the Submission in connection with the Site and Island Review’s editorial and promotional activities.
  • You waive, to the extent permitted by law, any right to inspect or approve the final presentation, editing, or placement of the Submission.
  • We may remove, edit, decline, or moderate Submissions at our discretion.

For commissioned work, paid contributions, or licensed photographs, the separate written agreement between Island Review and the contributor controls.

8. Affiliate links, advertising, and sponsored material

Some links on the Site may be affiliate links. If you click such a link and make a qualifying purchase or booking, Island Review may receive a commission at no additional cost to you. We may also receive products, hospitality, access, or other consideration from businesses discussed on the Site.

Commercial relationships do not buy favorable coverage, editorial approval, or immunity from an unfavorable adjective.

9. Disclaimer of warranties

To the fullest extent permitted by applicable law, the Site is provided on an “as is” and “as available” basis. Island Review makes no express or implied warranty regarding the Site or its content, including warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, non-infringement, availability, security, or uninterrupted operation.

This section does not exclude warranties or consumer protections that cannot lawfully be excluded, including mandatory rights available to consumers in the United States, the European Economic Area, the United Kingdom, or elsewhere.

10. Limitation of liability

To the fullest extent permitted by applicable law, Island Review and its publisher, owners, editors, contributors, employees, contractors, licensors, and agents will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages; loss of profits, data, goodwill, or opportunity; or loss arising from travel disruption, injury, illness, property loss, third-party services, bookings, or reliance on Site content.

To the extent Island Review is liable for a claim relating to your use of the free Site, our aggregate liability will not exceed the greater of:

  • USD $100; or
  • the amount you paid directly to Island Review for the relevant paid service during the 12 months before the event giving rise to the claim.

This limitation does not apply to liability that cannot be limited or excluded under applicable law, including liability for fraud, fraudulent misrepresentation, intentional misconduct, death or personal injury caused by negligence where such exclusion is prohibited, or mandatory consumer rights.

11. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold harmless Island Review and its publisher, owners, editors, contributors, employees, contractors, licensors, and agents from claims, liabilities, damages, losses, and expenses arising from your unlawful use of the Site, your breach of these Terms, or your Submission.

This section does not require you to indemnify us where such an obligation is unenforceable under the laws that apply to you.

12. Privacy and cookies

Our collection and use of personal data are described in our Privacy Notice.

Where required, we will provide appropriate cookie choices and obtain consent before using non-essential cookies or similar technologies. Your choices about cookies do not affect your access to essential Site functions, except where a function necessarily depends on the relevant technology.

If you are in the European Economic Area, the United Kingdom, or another jurisdiction with comparable protections, you may have rights to access, correct, delete, restrict, object to, or obtain a portable copy of certain personal data, and to withdraw consent where processing relies on consent. Details, including how to exercise those rights and lodge a complaint with the appropriate supervisory authority, belong in the Privacy Notice.

13. Copyright complaints

We respect intellectual-property rights. If you believe material on the Site infringes your copyright or other intellectual-property rights, please send a written notice to legal@islandreview.com containing:

  • Your name, contact details, and relationship to the rightsholder.
  • Identification of the copyrighted or protected work.
  • The exact URL or other information identifying the material you believe infringes your rights.
  • A statement that you have a good-faith belief that use of the material is not authorized by the rightsholder, its agent, or the law.
  • A statement that the information in your notice is accurate and, where applicable, that you are authorized to act for the rightsholder.
  • Your physical or electronic signature.

Where applicable, we will process notices and counter-notices under the Digital Millennium Copyright Act and other relevant law.

14. Changes to these Terms

We may revise these Terms from time to time. The updated version will be posted on this page with a revised effective date. If a change is material, we will provide additional notice where required by law, such as through the Site or by email to registered users.

Your continued use of the Site after the revised Terms take effect means that you accept them, except where applicable law requires a different form of consent.

15. Governing law and disputes

These Terms and any non-contractual obligations arising from them are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles.

If you are a consumer habitually resident in the European Economic Area, the United Kingdom, or another jurisdiction that gives you mandatory consumer protections, you retain the protection of mandatory provisions of the law of your country of residence. Nothing in these Terms deprives you of a right to bring proceedings in the courts that applicable law entitles you to use.

Subject to the preceding paragraph and to applicable law, the courts located in Delaware will have exclusive jurisdiction over disputes arising from these Terms or the Site.

Before filing a claim, please contact us at legal@islandreview.com and give us a reasonable opportunity to resolve the issue informally.

16. General terms

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

Our failure to enforce a provision is not a waiver of that provision.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, or operation of the Site.

These Terms, together with any linked policies and any applicable purchase or subscription terms, form the entire agreement between you and Island Review regarding your use of the Site.
